Terms of Service

These Terms of Service ("Terms") govern your access to and use of Covington Dispatch (the "Service"), provided by Wizard of Covington LLC ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms.
1. Eligibility and account
You must be at least 18 years old and operating a legitimate trade or service business to subscribe. You are responsible for the accuracy of the information you provide and for all activity under your account. Keep your password confidential.
2. Subscriber responsibilities
As a Subscriber using the Service to send SMS to your customers ("End-Customers"), you represent and warrant that:
- You have obtained the End-Customer's consent to receive SMS messages from your business prior to entering their phone number into the Service. The required disclosure language is published at /sms-policy.
- You will only send transactional SMS related to a specific service the End-Customer has engaged you to perform (invoice delivery, payment confirmation, manual reminders for unpaid invoices). You will not use the Service for marketing or promotional messages.
- You will honor opt-out requests promptly and will not re-add End-Customers who have opted out without obtaining fresh consent.
- You will not use the Service to send unlawful, harassing, misleading, or harmful content.
You are solely responsible for the content of messages you send and for compliance with applicable laws (TCPA, CAN-SPAM, state-level SMS rules, A2P 10DLC carrier requirements, and others). We may suspend or terminate accounts that we reasonably believe are non-compliant.
3. Fees and billing
The Service is offered on a monthly subscription. Pricing is shown on the homepage and may include a Newton County hometown rate for eligible businesses. A free trial may be offered at signup; at the end of the trial, you must select a paid plan to continue using the Service. Subscriptions auto-renew until canceled. Refunds are at our discretion.
End-Customer payments are processed through your own connected Stripe account. Stripe's standard processing fees apply and are paid to Stripe directly. We do not collect a per-transaction fee on End-Customer payments.
4. Your data
You retain ownership of all data you submit to the Service, including End-Customer records, jobs, line items, photos, and invoices. You grant us a limited license to host, process, and transmit that data solely to provide the Service. Our handling of personal information is governed by our Privacy Policy.
5. Service availability
We strive for high availability but do not guarantee uninterrupted access. Scheduled maintenance and unplanned outages may occur. The Service is provided on an "as-is" and "as available" basis.
6. Disclaimers and limitation of liability
To the maximum extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We are not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data. Our aggregate liability is limited to the amount you paid us in the twelve months preceding the claim.
7. Termination
You may cancel your subscription at any time from the Service. We may suspend or terminate your account for breach of these Terms, non-payment, or activity that creates risk for the Service or other users. On termination, your access ends and we will delete or anonymize your data per our Privacy Policy.
8. Changes to these Terms
We may update these Terms from time to time. Material changes will be communicated by email or through the Service. Continued use after changes take effect constitutes acceptance of the updated Terms.
9. Governing law
These Terms are governed by the laws of the State of Georgia, without regard to conflict of law principles. Disputes will be resolved in the state or federal courts located in Newton County, Georgia.
